\u00a7 1. Prohibition on Disclosure<\/strong><\/h2>\n

All information, including the real estate agent\u2019s property listings, is intended exclusively for the client. The client is expressly prohibited from disclosing the property listings and property information to third parties without the real estate agent\u2019s express consent, which must be obtained in advance. If the client violates this obligation and the third party\u2014or other persons to whom the third party has in turn disclosed the information\u2014enters into the main contract, the client is obligated to pay the commission agreed upon with the broker, plus value-added tax. <\/p>\n

\u00a7 2 Dual Employment<\/strong><\/h1>\n

The real estate agent is authorized to act on behalf of both the seller and the buyer in exchange for a commission.<\/p>\n

\u00a7 3 Owner Information<\/strong><\/h2>\n

The real estate agent notes that the property information provided by him originates from the seller or a third party commissioned by the seller and has not been verified by him, the real estate agent, for accuracy. It is the client\u2019s responsibility to verify the accuracy of this information. The real estate agent, who merely passes on this information, assumes no liability whatsoever for its accuracy. <\/p>\n

\u00a74 Limitation of Liability<\/strong><\/h2>\n

The broker’s liability is limited to cases of gross negligence or intentional conduct, provided that the client does not suffer bodily injury or lose his or her life as a result of the broker’s conduct.<\/p>\n

\u00a7 5 Prevention of Money Laundering<\/strong><\/h2>\n

When a specific purchase agreement is being negotiated, we are required, as part of our anti-money laundering measures in accordance with the Money Laundering Act (GWG), to verify and record the identities of the contracting parties, their representatives, and their beneficial owners. Our contractual partners are required to assist us in fulfilling this legal obligation in accordance with Section 11 of the GWG. <\/p>\n

\u00a7 6 Statute of Limitations<\/strong><\/h2>\n

The statute of limitations for all claims for damages by the client against the broker is 3 years. It begins on the date the act giving rise to the obligation to pay damages was committed. If, in an individual case, the statutory provisions on the statute of limitations result in a shorter limitation period for the broker, those provisions shall apply. <\/p>\n

\u00a7 7 Jurisdiction<\/strong><\/h2>\n

If the broker and the client are registered merchants within the meaning of the German Commercial Code, the broker\u2019s place of business is agreed upon as the place of performance for all obligations and claims arising from the contractual relationship and as the venue for legal proceedings.<\/p>\n

\u00a7 8 Consumer Arbitration Board<\/strong><\/h2>\n

The European Commission provides an online dispute resolution platform at http:\/\/ec.europa.eu\/consumers\/odreine<\/a>. Consumers can use this platform to resolve their disputes.
